На картине Герарда Давида, законченной в 1498 году (тогда картины писали годами, а сегодня Beeple каждый день выдаёт — не пожалейте несколько минут и посмотрите на ежедневки «Beeple everydays», ссылку я не даю, их фейсбук не любит, но две секунды в гугле стоят того, правда можно зависнуть на несколько часов, как это произошло со мной, volenti non fit injuria) — первая часть диптиха «Суд Камбиса», или «Сдирание кожи с продажного судьи».
Вторую часть я не буду показывать, чтобы фейсбук меня не наказал — иди знай, как сработают алгоритмы, полного понимания работы которых нет уже и у программистов фейсбука. Контекст самой картины я привожу в конце, чтобы не отвлекать вас от прекрасной истории из Америки, а впоследствии — и от истории в Израиле. Хотя знаете что? Давайте начнём с Израиля!
Меня достаточно долго терзал вопрос — что значит «исключение, которое подтверждает правило»? Если есть правило — то оно правило, а если есть исключения — то как и почему они подтверждают правила?
Но вот вам отличный пример — израильский судья Дан Коэн. Спроси любого израильтянина, было ли такое, чтоб судья взял взятку — и сразу же вспомнится это имя. И вспомнится оно потому, что СУДЬИ В ИЗРАИЛЕ ВЗЯТОК НЕ БЕРУТ.
Я всего лишь несколько дней в профессии, всего четверть века. За это время я близко и искренне общался с крутыми взрослыми адвокатами, которые были — и есть — в первых рядах в нашей профессии. И ответ на вопрос, берут ли судьи, всегда был однозначный — нет, не берут. «Если бы брали, я бы уж как-то это знал», говорил мне каждый из них — и это были люди, которые знали очень, очень много из того, о чём не пишут в газетах.
А как же Дан Коэн, спросите вы? Известный на всю страну судья, который брал взятки?
Дан Коэн был БЫВШИЙ судья, который ушёл в бизнес и стал директором в Хеврат Хашмаль — электрической компании Израиля. И в бытность её директором он получил откат от фирмы Siemens. Был пойман, сбежал в Перу, был оттуда выдан в Израиль и отсидел чуть больше трёх лет, выплатив штраф в 10 миллионов шекелей.
Он не был судьёй, когда брал откат от немцев (те ещё цивилизованные европейцы, честные и не коррумпированные), больше десяти лет как не был судьёй после того, как в ходе процесса высказал что-то (что до сих пор не опубликовано) в адрес Верховного Суда, за что был сослан в суд Назарета и в результате ушёл из судейства.
Но в общественном сознании жителей нашей страны он остался судьёй, который взял взятку, и тем самым исключением, которое подтверждает правило — В ИЗРАИЛЕ СУДЬИ ВЗЯТОК НЕ БЕРУТ.
На самом деле я хотел написать не об этом, а о деле Kids for Cash — интересно, что гугль работает очень хорошо и сразу же нашёл это дело по запросу «children for money». Но вышло и так уже длинно, поэтому подробнее о том, как федеральные судьи с Америке засылали детей в частную тюрьму за откаты от хозяина тюрьмы, я напишу в следующем выпуске нашего познавательного альманаха.
А сейчас — о продажном судье Сисамне (госсспади, почему я уже который раз читаю Сисамн как «сисадмин»? можно его уже в devops переименовать), арест которого изображён на картине. Надо сказать, что наказания в ту пору были, мягко говоря, строгие. Смотрите, что пишет об этом Геродот:
25. Так сказал Дарий. Затем царь поставил сатрапом Сард своего сводного брата Артаферна и вместе с Гистиеем отбыл в Сусы.
Отана же он назначил начальником войска в Приморской области. Отец этого Отана — Сисамн был одним из царских судей. За то, что этот Сисамн, подкупленный деньгами, вынес несправедливый приговор, царь Камбис велел его казнить и содрать кожу.
Кожу эту царь приказал выдубить, нарезать из неё ремней и затем обтянуть ими судейское кресло, на котором тот восседал в суде. Обтянув кресло, Камбис назначил судьёй вместо Сисамна, которого казнил и велел затем содрать кожу, его сына, повелев ему помнить, на каком кресле восседая, он судит.
