На фотографии — бланк, который дают подписать каждому, кто имел счастье быть допрошенным в полиции Израиля. Это, собственно, и есть наша Миранда — предупреждение о праве на молчание и праве на адвоката, которое впервые появилось в США после знаменитого дела Miranda vs. Arizona и которое вы неоднократно слышали в американских фильмах, сериалах и анекдотах.
Бланк этот, как видите, аж на четырёх языках — дабы в нашем мультиязычном Израиле никто не был дискриминирован, поэтому сперва идёт иврит, а потом перевод для неивриточитающих граждан. Перевод на три языка — арабский, английский и амхарский, для арабов и олим хадашим, чтоб незнание письменного иврита не лишало граждан их основных прав и свобод.
Если к этой строке у вас не появился конкретный вопрос, дайте мне сформулировать его для вас. Где русский язык, чорт побери? На сегодняшний день в Израиле проживает как минимум сотня-другая тысяч человек, которые не в состоянии прочитать и понять всё, что написано в этом бланке — а там, например, в отличие от США, прописана расплата за молчание.
Это, кстати, интереснейший феномен трансформации принципа презумпции невиновности на пустынной израильской почве. По-правильному менты должны доказать, что я преступник — и я не обязан им вообще ничего объяснять, если не хочу. От этого есть и право на молчание, закреплённое Пятой Поправкой к Конституции США.
Я, кстати, вообще не особо пафосный товарищ, не парюсь внешними понтами, обращаясь к людям письменно пишу вы не с большой буквы, в кабинете зачастую сижу в шортах и шлёпках и на стенах у меня нет ни одного диплома, кроме фотографии момента рубки катаной. Это, как я объясняю, мой самый важный диплом — если что, срублю башку нахуй.
Но к Конституции США и поправок к ней у меня особый пиетет. Я думаю, что это самый крутой юридический документ в мире, а поправки к ней, гарантитующие основные права и свободы граждан, тоже достойны того, чтоб писаться с большой буквы — Первая (свобода слова), Вторая (свободное владение оружием) и Пятая (право на молчание).
В США — да и во всём остальном относительно нормальном, насколько это может быть в 2020 году, мире — право на молчание означает, что ты можешь молчать в полиции и это ок. Более того, подсудимый далеко не всегда выступает в суде — если у прокуроров не всё сошлось хорошо и гладенько, то зачем мне поднимать моего клиента на свидетельство? Он мне нанесёт, стараясь не расплескать, полной чуши, и будет только хуже.
В отличие от всяких там гоев, евреи умные (а главное — хитрые) и право на молчание как бы есть, но как бы может выйти боком, потому что в определённых обсоятельствах судья может его использовать для вынесения обвинительного вердикта. и это написано в предупреждении. Которое на иврите. И на английском. И на арабском. И на амхарском.
Но не на русском. Почему? Загадка. Судя по всему… Чёрт, не знаю и не хочу гадать — но кто-то так решил, и так оно и стало. Не то чтоб я мог прийти к очередному временно исполняющему должность начальника полиции (постоянного у нас, по-моему, уже чуть ли не несколько лет не имеется — как в своё время всех претендентов на эту должность срубили отрадой минит это особая веселейшая история) и сказать — а давай поменяй.
В результате у меня одно за другим дела, где люди не понимали, что там написано. Не каждый русскоязычный в Израиле хорошо читает на юридическом иврите, особенно в момент стресса на допросе. Суют что-то на иврите и говорят подписать — и 90% подписывают, не знаю что. И нельзя сказать «что ж ты, дурачок, подписал» — потому как я и сам бы, не будучи адвокатом, подписал бы.
Не думаю, что это сознательная дискриминация русскоязычных граждан. Однако в судах в Израиле практически совсем нет русских судей — за исключением нескольких, кого можно пересчитать по пальцам одной руки. Религиозные всех степеней есть, арабы (и христиане, и мусульмане), и бедуины — есть, а русских почти нет.
Думаю, если было бы побольше русских судей, эта хрень бы не прокатила раньше или позже. Я неоднократно сталкивался в судах с двумя главными типами «неврубания» — бабло и язык.
Во-первых, далеко не все судьи понимают, что такое НЕТ ДЕНЕГ. То есть назначает судья в каком-нибудь деле залог в 30 тысяч, а я говорю — нет таких денег у людей, физически нет. А судья мне говорит — а что ты хочешь, залог в пять копеек? 30 тысяч это мелочи, если твоим клиентам это так важно — они найдут. И как ты объяснишь такому, что не у всех есть возможность вынж-да-положить 30 штук?
Во-вторых, далеко не все судьи понимают, что значит НЕТ ЯЗЫКА. То есть смотрит судья на человека, который говорит, что не понял ничего, что написано в бланке, и говорит «вы, господин, уже 8 лет в Израиле, не надо меня дурить, что иврит не понял». И как ты объяснишь такому, что не каждый выучил иврит до уровня чтения юридических текстов?
Думаю, что если бы было побольше русских судей, такие вопросы бы озвучивались в их решениях — и, соответственно, практика судебных решений и поведения полиции могла бы измениться. Однако… Однако русских судей пока не 15%, в соответствии с процентом русскоязычного населения в Израиле. И даже не 5%, а скорее всего дай бог если человек 5 наберётся из 661, то есть меньше процента. То есть в 15 (ПЯТНАДЦАТЬ) раз меньше, чем доля населения.
Если это не дискриминация, то что это?
